An internal investigation may begin with a meeting request from human resources, a message from compliance, a notice from a dean, or an email from an outside law firm retained by your employer or school. You may be asked to attend an interview, provide documents, answer written questions, or sign a statement.
Speak with your own lawyer before the interview. The organization’s lawyer represents the organization, even if that lawyer asks you questions about your conduct or asks for your account of events. In a corporate investigation, the organization generally controls the attorney-client privilege over its communications with company counsel, not the individual employee.
Keep relevant messages, emails, files, calendars, photographs, and notes in their current form. Bring the notice, meeting invitation, policy, or other documents you received to your consultation.
Communications with our office are confidential.

Before founding Iseman PLLC, Scott spent seven years at O’Connell & Aronowitz, including three years as a partner. In 2020, he taught a New York State Bar Association course for corporate counsel on responding to law-enforcement contact.
“The context matters. A written report or interview summary can leave out facts that explain what actually happened.”

College Misconduct Allegations Dismissed Before a Hearing
A student at a private college was accused of misconduct by a classmate. The college began an internal investigation.
The firm conducted its own investigation and collected witness statements, messages, and photographs. The defense presented that information during the school’s investigation. The college dismissed the allegations, and no hearing occurred.

The student was found not responsible and completed his degree.
Representation for a Reporting Student
The firm represented a student who reported sexual violence. The firm helped the student organize supporting evidence and prepare for investigative interviews and a hearing. The responding student was found responsible and disciplined.
Workplace Matter That Became a Criminal Case
A corrections officer faced criminal charges related to workplace conduct. The case went to trial, and the jury did not reach a verdict. The client later accepted a negotiated resolution rather than face a second trial. The agreement preserved appeal rights, and the appeal remains pending.
Prior results do not guarantee a similar outcome. The third matter resulted in a hung jury and negotiated resolution, not an acquittal. The appeal has not been decided. Schools, employers, and client names are withheld.

Internal Investigation Questions for New York Employees
What people ask before they walk into the room.
Human resources scheduled a meeting. Should I speak with a lawyer first?
Yes. Bring the meeting notice, relevant emails, and any policies you received to a consultation. A lawyer can help you understand the purpose of the meeting and prepare for questions.
The company gave me a lawyer. Do I need my own lawyer?
A lawyer hired by the company represents the company. You may need separate counsel if your job, professional license, reputation, or potential criminal exposure could be affected.
No one contacted the police. Is hiring a lawyer premature?
No. An internal investigation can affect your employment, professional license, education, or future government investigation even when police are not involved.
Will you communicate with the organization for me?
When appropriate, the firm can communicate with an employer, school, investigator, board, or the organization’s lawyer. The appropriate approach depends on the investigation, the deadline, and the client’s role.
What should I bring to the first meeting?
Bring the meeting invitation, notice, relevant policies, emails, texts, files, and the names of people who contacted you. Preserve those materials and do not delete or alter them.
What does it cost to work with Iseman PLLC?
Fees depend on who is conducting the investigation, the allegations, the deadline, the expected interview or hearing, and whether a written response is needed. The firm explains fees before representation begins.
Do you handle school and campus matters?
Yes. The firm represents students accused of misconduct and students who report misconduct. School rules differ, but many colleges allow an advisor or attorney to assist a student during disciplinary proceedings.
Who will work on my matter?
You work directly with your attorney. Michael Blasie assists with research and written work when needed.
