During cross-examination, weaknesses emerged in the prosecution’s expert evidence. Additional information favorable to the defense also came to light. Before the prosecution finished presenting its case, the court dismissed every charge.

Our Case Results
The theory itself is now on appeal
New York prosecuted a corrections officer on a duty-to-intervene theory assembled from a workplace handbook. The jury could not agree, and the resolution capped our client’s exposure while reserving that exact legal question for appeal.
Twice overturned at the Supreme Court
Convictions in one of New York’s highest-profile federal fraud prosecutions were overturned twice by the United States Supreme Court on the lawfulness of the government’s theory. Our founder served on the defense trial team.
Acquitted of both firearm counts
In federal court we argued entrapment: the crime existed because the government manufactured it. The jury acquitted our client of both firearm counts.
